To ensure that this Apartment has publicness (is accepted by public) and provides a safe and comfortable stay to guests, the following rules need to be followed: Not abiding by these rules may lead to cancellation of stay and/or refusal to use the hotel facilities.
General Rules
The Guest must be at least 18 years old and is fully responsible for all persons staying in the apartment.
The apartment is located in an upscale, quiet residential complex (Aura Higuerón, El Higuerón) and must be treated with respect and care. Any damage, breakage, or abnormal wear will be charged to the Guest.
Quiet hours must be strictly observed: no excessive noise after 23:00 and before 07:00, so as to respect the community’s calm environment.
The maximum number of guests must not be exceeded.
The Guest must observe all building and complex rules, including access to shared amenities, garden areas, pool zones, waste disposal regulations, and safety procedures.
Smoking inside the apartment is strictly prohibited. If found smoking indoors, an additional cleaning fee will apply.
Pets are allowed only if explicitly agreed in advance.
All furniture, fixtures and inventory must remain in the apartment and must be returned in the same condition as at check-in.
Flexible reservation conditions:
The reservation is confirmed only when full payment or the agreed deposit has been received.
The Guest must provide accurate and complete personal and contact information at the time of booking.
The Owner reserves the right to decline any reservation at their discretion without obligation to explain.
The price for the stay depends on seasonality, number of guests, length of stay, and any special conditions applicable to the Aura Higuerón property.
Non-refundable reservation conditions:
All payment transactions must be completed within the timeframe specified at reservation.
Some reservations may be marked as non-refundable; this will be clearly indicated before payment is made.
For non-refundable bookings, no refund will be provided under any circumstances, including illness, cancellation of travel, or unforeseen events.
Any costs relating to bank transfers, currency conversions or payment processing fees are the responsibility of the Guest.
Where a security deposit is required, it will be held and refunded after check-out provided that the apartment is returned in good condition and all terms are complied with.
Cancellations & Changes
All cancellations must be submitted in writing (email or other verifiable means).
For bookings not designated as non-refundable:
Cancellations made more than 30 days prior to arrival: full refund.
Cancellations made between 14 and 30 days prior to arrival: 50% refund.
Cancellations made less than 14 days prior to arrival: no refund.Any later reports will not be taken into consideration.
Requests to change booking dates or number of guests are subject to availability and the Owner’s approval.
A “no-show” (the Guest failing to arrive without prior cancellation) qualifies for no refund.
Check-In & Check-Out
Standard check-in time is from 15:00 local time unless otherwise agreed in writing.
Check-out must be completed by 11:00 local time. Late check-out may incur additional charges.
The Guest must return all keys/access devices. Loss of keys or access cards will incur replacement charges.
Cleaning
The Guest is expected to keep the apartment in a reasonably clean condition during the stay.
Final cleaning is included unless otherwise stated. However, additional charges may apply for:
Excessive dirt or mess.
Large amounts of bottles/cans or garbage left behind.
Special stains requiring laborious removal.
Detection of smoking inside the apartment will result in an extra cleaning fee.
Damages, Loss & Liability
The Guest is financially responsible for:
- Broken, lost or missing items.
- Damage to furniture, fixtures, inventory or finishes of the apartment.
- Water damage caused by negligence (e.g., leaving a tap running).
- Loss of keys, remote controls/access cards.
The Guest must notify the Owner of any damage or malfunction immediately.
The Owner is not liable for loss or theft of the Guest’s personal belongings.
The Guest is responsible for damage caused by any third party that the Guest admits into the apartment or common areas.
Rule Violations
Serious violation of any rule may lead to:
- Immediate termination of the stay, without refund.
- Additional charges for damage or extra work required.
- Eviction from the premises without compensation.
Illegal activities, excessive noise, or other disturbances may result in contact with local authorities.
Area & Shared Facilities at Aura Higuerón
The apartment is part of a luxury residential complex, offering shared amenities such as landscaped gardens, swimming pools, and panoramic views.
Use of shared facilities is subject to the complex’s rules; the Guest must follow the posted guidelines regarding hours of use, guest limits, and safety.
The Owner is not responsible for temporary closure or maintenance of communal areas (pools, gardens, gym, etc.).
The Guest agrees to respect the community’s quiet, high-end environment and not undertake activities which compromise other residents’ enjoyment.
Unexpected Events (Force Majeure)
The Owner shall not be liable for any failure to fulfil obligations due to causes beyond reasonable control, including but not limited to:
- Power or water outages.
- Elevator malfunction or building maintenance issues.
- Natural disasters, weather conditions, or public health restrictions.
- Strikes, protests, travel bans or government action.
- Technical faults or errors not immediately resolvable.
In such cases, the Owner will strive to assist the Guest but is not obligated to offer refunds.
Privacy & Information
The Guest’s personal data will be used solely for managing the booking and stay.
No information will be shared with third parties unless required by law.
The Guest consents to the Owner using basic booking data for administrative purposes and communications related to the stay.
Acceptance of Terms
By confirming the reservation, the Guest acknowledges and agrees to all terms set out in this document.
